What you call hacking is essentially reverse engineering of the network and client code in order to reproduce the server code, which is completely unknown, and therefore a huge challenge. What has been done is an emulated bnet server, which is what the client connects to, instead of the real bnet. The client hasn't been altered in any way (except for commandline parameters which Blizzard put there). The one that both SC2 and WoW create as well. And I think you can change ingame settings in 'legit' D3 beta by changing some lines in preferences file D3 creates when you install the game.
